Terms and Conditions

1. Introduction

By accessing or using the SaaS services provided by Ben McDowell Coaching Pty Ltd (“we,” “our,” or “the Company”), you (“you,” “user,” or “client”) agree to be bound by the following Terms and Conditions (“Terms”). These Terms govern your use of the dashboard templates, pipelines, automations, integrations, workflows, and any other services delivered via our GoHighLevel (GHL) SaaS infrastructure.

2. Service Description

The SaaS offer includes templates for dashboards, pipelines, automations, integrations, and workflows. These templates are to be populated by the client and hosted via a sub-account on our white-labeled GoHighLevel platform. Ongoing updates are provided as long as the user remains subscribed to our service.

3. Account Registration & Eligibility

  • You must be 18 years of age or older.

  • You are solely responsible for maintaining the confidentiality of your login credentials.

  • We may access your account internally to provide support but will never sell or distribute your login credentials or data.

4. Subscription & Payment Terms

  • Subscriptions are billed monthly and automatically renew unless cancelled with 14 days' notice.

  • If cancellation is initiated within 14 days of the next billing cycle, the upcoming payment will still be processed.

  • A $5 processing fee applies to failed payments. If unresolved within 7 days, the account and associated data may be restricted until the funds are made available.

 5. User Responsibilities

  • You agree to use the service lawfully.

  • You will not use the platform to spam, overload system resources, or engage in illegal activity.

  • Redistribution or resale of templates, workflows, or IP is strictly prohibited.

  • You must comply with applicable laws (e.g., TCPA, CAN-SPAM) when sending emails, texts, or calls.

6. Data & Content Ownership

  • You own all personal and client data inputted into your sub-account.

  • You grant Ben McDowell Coaching Pty Ltd permission to access your account for setup, support, and technical purposes.

  • If you default, miss or otherwise do not fulfil payments for the GHL account and/or the service fee, or behave in a disrespectful or abusive manner toward a member of staff, your access may be restricted until obligations are resolved.

7. Intellectual Property

  • All templates, systems, and infrastructure are the exclusive intellectual property of Ben McDowell Coaching Pty Ltd.

  • Unauthorized redistribution, duplication, or resale will result in immediate account suspension and possible legal proceedings.

  • Upon full program completion and payment for both the services implementation fee along with payment for the monthly use of your GHL account, you may request:

    • (A) Full release of your sub-account, you will then manage the account entirely by yourself; or

    • (B) Continued access through our agency, including system updates, and support from GHL so long as they offer it, as long as your subscription remains active.

8. Termination

  • Either party may terminate the agreement at any time with 14 days’ notice.

  • If we terminate your account and all relevant financial obligations have been met, we will release the sub-account to preserve your data.

9. Limitation of Liability

  • We are not liable for any damages, losses, revenue impact, system errors, or third-party failures while you use the platform.

  • You accept full responsibility for outcomes experienced or not experienced through or because of the use of this service.

  • We make absolutely no guarantees or claims that the use of the platform will provide revenue, cash, call booking, lead volume or any other marketing or sales unit of measurement. These are the sole responsibility of the client.

10. Disclaimer of Warranties

  • Services are provided “as-is” and without guarantees of uninterrupted access or error-free functionality.

  • We disclaim all warranties, express or implied.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia.

12. Amendments

We may update these Terms at any time. Clients will be notified via email of any material changes.
